General conditions of sale Cottages and bed and breakfast at Le Moulin de Prédelles

Article – 1: This seasonal rental contract is reserved for the exclusive use of the cottages and bed and breakfast located at Le Moulin de Prédelles Les Prédelles Chemin du Largue 04110 REILLANNE

Article – 2: duration of the stay: The signatory tenant of the present contract concluded for a determined duration will not be able under any circumstances to prevail himself of an unspecified right to maintain in the places at the end of the stay.

Article – 3: conclusion of the contract: The reservation becomes effective as soon as the tenant has sent the owner a deposit of 30% of the total amount of the rental at the time of reservation, the balance one month before the planned date of entry into the premises and a copy of the contract signed before the date indicated on the front. A second copy is to be kept by the tenant.

The rental concluded between the parties to the present contract may not under any circumstances benefit, even partially, third parties, natural or legal persons, except with the written agreement of the lessor.

Any infringement of this last paragraph may lead to the immediate termination of the rental at the tenant's expense, the proceeds of the rental remaining definitively with the lessor.

Article – 4: Cancellation by the tenant: Any cancellation must be notified by registered letter by post or e-mail to the lessor.

a) Cancellation more than 30 days before the planned date of entry into the premises, the deposit shall be retained by the lessor

b) Cancellation less than 30 days before the planned date of entry into the premises: the deposit and the balance paid shall be retained by the lessor, unless the lessor has been able to re-let the accommodation under the same financial conditions

c) If the tenant does not show up within 24 hours of the arrival date indicated on the contract, the deposit and the balance remain the property of the lessor. In this case, the present contract becomes null and void and the owner may dispose of his cottage or bed and breakfast

d) If the stay is shortened, the rental price remains the property of the owner. In this case, no refund will be made.

Article – 5: Cancellation by the owner: The owner will pay the tenant the total amount paid.

Article – 6: Arrival: The tenant must arrive on the day and at the time mentioned on the present contract. In case of late or delayed arrival, the tenant must inform the owner.

Article – 7: Payment of the balance: The balance of the rent is paid one month before the planned date of entry into the premises

Article – 8: Inventory of fixtures: An inventory is provided and signed by the tenant and the owner or his representative on arrival and departure of the cottage. This inventory is the only reference in the event of a dispute concerning the state of the premises.

At the time of the inventory, the state of cleanliness must be noted by both parties. If the state of cleanliness is unsatisfactory, the tenant may demand additional cleaning on arrival if he/she considers that the cleanliness is not satisfactory. Similarly, cleaning costs may be requested in addition, even though they are included in the fixed price, if the cottage is returned in a poor state, as the tenant is obliged to use the rented property in a good state.

Article – 9: Security deposit : On the arrival of the tenant, a security deposit, the amount of which is indicated on the front of this contract, is requested by the lessor. This deposit is returned within one month of the end of the rental period, after deduction of the cost of repairing the premises if any damage is found.

Article - 10: Use of the premises:

The tenant is required to:

1 ) To occupy the premises only in a bourgeois manner, to the exclusion of the exercise of any trade, profession or industry, the Tenant acknowledging that this rental is granted to him only as a temporary residence and for pleasure, a major condition without which the present rental would not have been granted to him.

2 ) Not to do anything which, by his own doing or that of his family or relations, may disturb the peace of the neighbourhood.

3 ) To occupy the premises personally and not to sublet the premises under any circumstances, even free of charge, nor to transfer his rights to the present rental unless the lessor has given his written consent.

4 ) Not to store furniture under any circumstances, except for linen and small objects

5 ) Not to make any modification or change in the layout of the furniture and the premises

6 ) Not to introduce any pet into the rented cottage without prior authorisation from the lessor

7 ) Not to allow any work to be carried out during the rental period in the rented premises which is clearly not urgent enough to be postponed

8 ) Maintain the rented premises and return them in a good state of cleanliness at the end of the rental period

9 ) To inform the lessor or his representative immediately of any damage or deterioration occurring in the rented premises, even if there is no apparent damage

10 ) To be responsible for any damage or loss caused by his/her own actions or those of the persons accompanying him/her during the use of the cottage

Article – 11: capacity: The present contract is established for a maximum capacity of persons. If the number of tenants exceeds the capacity of the cottage, the owner may refuse to accept additional persons. Any modification or breach of contract will be considered at the client's initiative.

Article – 12: Insurance: The tenant is responsible for all damage caused by him. He must be insured by a holiday insurance contract for these different risks.

Article – 13: Disputes: Any complaint relating to the state of the premises and the state of the description during a rental, must be submitted to the RANKING ORGANIZATION within 3 days of entering the premises. Any other complaint must also be sent to the RANKING ORGANIZATION as soon as possible, by letter.

In the event of persistent disagreement, disputes may be submitted to the arbitration of the RANKING ORGANIZATION, which will endeavour to find an amicable agreement.
